The following terms and conditions govern the relationship between Tristar Safaris and you, our valued client. Tristar Safaris supposes that you are of sufficient legal age to use the website and create binding legal obligations. These are the terms and conditions that will apply and by signing up for a Tristar Safaris Ltd tour or any other service therein, you accept to be bound by these terms and conditions.
3rd Party Suppliers
Tristar Safaris acts solely as a booking agent for hotels, airlines, ground transporters, boat operators, hot air balloon companies and other independent contractors providing accommodations, transportation, and other services from various independent suppliers that Tristar Safaris subcontracts on behalf of its clients. Each of these suppliers and entities are independent contractors and are not subject to the control of Tristar Safaris.
Tristar Safaris therefore will not be liable for any death, personal injury, property damage, loss, accident, delay or irregularity which may occur as a result of using such subcontracted services. However, Tristar Safaris will always endeavor to contract services of companies which in Tristar Safaris discretion deliver the contracted services in the appropriate quality while adhering to the laws of the land.
In the event that any supplier is unable to provide contracted services for whatever reason, Tristar Safaris will endeavor to offer you alternative arrangements of similar classification whenever possible. Should you not be willing to take the alternative arrangements offered by Tristar Safaris, any refunds to which you may be entitled will be subject to the terms and conditions of the relevant supplier.
You may not delegate, convey or assign your rights, duties and obligations entered with Tristar Safaris.
"Force Majeure" means any circumstances where the execution of contractual services is prevented or affected by factors beyond the reasonable control of Tristar Safaris including, but not limited to acts of God, war and threat of war, civil strife, industrial dispute, terrorist activity, natural disasters such as weather conditions, earthquakes, volcano eruptions, fire, governmental actions, sickness, quarantine, travel warnings or bans and other unexpected occurrences.
In these circumstances, we shall not be liable to pay any compensation or otherwise be responsible for any expenses or losses the client may incur where we are forced as a result to cancel, delay, curtail or change the clients' arrangements in any way or where the performance or prompt performance of our contractual obligations is prevented or affected.
Tristar Safaris also reserves the right to accept or decline any traveler on any trip, before or during the trip should such person's mental or physical condition impede the operation of the service or the rights, welfare or enjoyment of other travelers. In this case, a refund of the unused land services is the limit of Tristar Safaris liability to the traveler removed.
We also reserve the right to alter or modify the itinerary of any tour or relocate accommodation if schedules, security matters and/or events beyond our control make such explained above.
Weight restrictions may apply on internal flights. Baggage and personal effects are at the owner’s risk throughout the travel program. Confirmations for baggage restrictions applicable to international flights should be made with the airline.
It is the client's responsibility to ensure that their passport, visa, health certificates, inoculations, or other documentation required for the trip are obtained, valid and that are all in order. Should Tristar Safaris incur any costs as a result of failure by the client to fulfill this responsibility, such costs shall be recovered from the client.
Malaria is endemic in some parts of Africa and precautions must be taken. It is recommended you visit your primary physician or local travel clinic to review any medications or recommended inoculations. Be sure to carry your inoculation certificate with you as proof of inoculations. If you are concerned about taking any medications, check with your physician before you book your trip.
Special Requests & Important Information
The client must either directly or through their travel agent, advice Tristar Safaris Ltd in writing of any special requests or important information about themselves such as diet, physical disability and any need for special treatment or handling at the time of booking.
'The booking' refers to part or all of the travel arrangements for transportation, accommodation, flights, sightseeing excursions, meals, entertainment and other linked services made on behalf of the client, some of which may be subcontracted from other independent suppliers. A binding contract between you, the client and Tristar Safaris Ltd comes into existence when we receive your booking request and a deposit payment for the booking.
A deposit of 35% of the total booking value is required in order to confirm part or all of the booking. Certain suppliers impose more stringent payment policies. Should your program include services of such suppliers, Tristar Safaris Ltd will advise you at the time of booking if your booking will require some additional deposit payments.
The balance is payable 60 days before the date of the first service by Tristar Safaris Ltd. Should the client fail to remit payments in line with these set time frames, Tristar Safaris Ltd reserves the right to treat the booking as cancelled and thereby apply any resultant penalties.
Cancellations by Client
Cancellations of part or all of a booking must be received by Tristar Safaris in writing at least 61 days before the service date. Cancellations received less than 61 days before the service date will incur the following penalties:
- Between 90 and 61 days - 10% of the total booking value
- Between 60 and 35 days - 25% of the total booking value
- Between 34 and 25 days - 35% of the total booking value
- Between 24 and 14 days - 50% of the total booking value
- Between 13 and 0 days - 100% booking value
All guests are strongly advised to take out comprehensive travel insurance covering them for luggage, personal effects, personal accident, medical and emergency travel expenses, cancellation and curtailment of travel arrangements because bookings will be subject to cancellation penalties as detailed above.
Cancellations or Changes by Tristar Safaris Ltd
Tristar Safaris reserves the right to discontinue and summarily cancel any booking in respect of which payment has fallen in arrears. In the event of this right being exercised, relevant cancellation penalties will be payable by the client or deducted from any deposit payments already made.
Note: Tristar Safaris is committed to maintaining a close and mutually beneficial relationship with all its clients. We realize that the satisfaction of our clients is our greatest asset. Our morals therefore are guided by a high level of professionalism, honesty and Integrity.
From the time you send us your first enquiry, you will be served by a dedicated consultant till the time you return home. Your travel arrangements will be reviewed every so often in order to eliminate chances of errors and omissions.
In the unlikely event that Tristar Safaris Ltd has to cancel, amend or curtail your travel arrangements due to our negligence, our failure to exercise care in making the arrangements for you and /or breach of our contractual agreement, we will take liability.
In regards to game viewing, please be advised there are no guarantees. It is a privilege to see animals in their natural habitat. Take photographs only, leave only a footprint. The tour only guarantees taking you to the natural habitat of the animals.
Assumption of Risk
You understand and accept that your proposed tour may expose you to inherent dangers including but not limited to physical exertion, equipment failure, dangers of animals, inaccessibility to medical attention in remote locations in case of an emergency. You acknowledge that alterations to the schedule itinerary or activity may be made as necessitated by weather, group size, road transport, road closures, illness or other factors. You agree to accept the decisions of the tour leader or representative, and you accept that neither we nor the providers of services can be held responsible for expenses or inconvenience incurred as a consequence. You acknowledge that the enjoyment of your tour or holiday is derived in part from travel beyond the safety risks of life at work or at home, and you accept and assume all the risks involved.
While great care and effort has been taken while compiling the data and information contained on this website, Tristar Safaris do not warrant the accuracy, completeness or fitness for a particular purpose of any content found on this site. We therefore should not be held liable for any errors or omissions nor for any charges or liabilities incurred by any organization or individual as a result of using the information on this site.
We will endeavor to resolve any complaints to your satisfaction and within reasonable time. In the unlikely event of you remaining dissatisfied please write to us setting out your complaint in detail within seven days of the end of the travel arrangements. Any complain arising after the stipulated period will have been overtaken by events.
A binding contract between you and Tristar Safaris only comes into being after you have fulfilled any terms applicable for the confirmation of a booking and your reservation has been accepted and a confirmation advice issued to you through e-mail. The date of the contract is the date that appears on the confirmation advice.
Where you have a contract, this contract will be governed by the laws of the country in which the services you require will be rendered and will be subject to the exclusive jurisdiction of the courts of that country. Tristar Safaris reserves the right to increase or decrease prices quoted at the site at any time before your booking is made and confirmed.
While all precautions are taken to ensure your safety and enjoyment such services as you may purchase, Tristar Safaris and/or its agents and suppliers shall not be liable for: death, injury, delay, loss or damage arising from any cause and in any manner whatsoever; change of itinerary; acts of terrorism, acts of God or government; neglect, accident, error or omission caused by any of these suppliers or independent contractors, their employees, representatives; or, any event beyond the control of Tristar Safaris.
All baggage is carried at the traveler's own risk and where applicable Tristar Safaris reserves the right to exclude certain baggage at its discretion. Tristar Safaris may at any time modify these terms and your use of the services at the website is conditional upon the terms in force at the time of your use.
